Federal Judge Allowed to Interfere with Plea Negotiations

In a prosecution for Wire Fraud, bankruptcy fraud, bank fraud, perjury, tax evasion, filing false tax returns, and procuring false documents to Internal Revenue Service, the district court did not impermissibly interfere with plea negotiations, in violation of the rule of criminal procedure governing pleas. After defense counsel had informed the court mid-trial that the defendant intended to plead guilty, the court mentioned to counsel in chambers that the court had noticed that two or three jurors were looking at the defendant when he began testifying, but none of the jurors would look at him by the time his testimony was finished. There were no plea negotiations occurring when the court made the statement, and the court did not participate in any discussion regarding the defendant's decision whether or not to plead guilty.
